Terms & Conditions

These Terms govern your use of PlatoQR, the website, and related services.
If you do not accept them, please do not use the platform.

1. Introduction

These Terms and Conditions of Service (“Terms”) govern access to and use of PlatoQR (the “Platform”) and the related services (collectively, the “Services”).

Use of the Services is also subject to our Privacy Policy and, where applicable, our Cookie Policy, which explain how we handle data and how cookies and similar technologies work.

Important

If you are using PlatoQR for a restaurant or business, you confirm that you have the authority to accept these Terms on behalf of the organization.

2. Key definitions

Parties

  • “PlatoQR”, “we”, “us”: the provider of the Platform and Services.
  • “Customer” or “User”: anyone who creates an account or uses the Services.
  • “Guest”: anyone who views a menu/site published with PlatoQR (e.g., via QR code).

Services

  • Creation and publishing of digital menus and restaurant pages.
  • Tools to update content, translations, and allergen management.
  • Optional modules: bookings, reviews, contact tools, etc.

Content

  • “Customer Content”: text, images, prices, allergens, opening hours, and any data provided by the Customer.
  • “Output”: content generated/assisted (e.g., translations) from Customer Content.
  • “PlatoQR Materials”: layouts, software, templates, components, and documentation.

Plans & Billing

  • “Plan”: the set of features and limits associated with a tier (Free/Paid).
  • “Billing period”: monthly/annual (where applicable).
  • “Renewal”: automatic continuation unless canceled (where applicable).

3. Account, eligibility, and security

To use certain features you may need to create an account. The Customer agrees to provide accurate information and keep it up to date.

  • You are responsible for activity under your account and for safeguarding your credentials.
  • You must not share passwords or grant access to unauthorized third parties.
  • You must promptly notify us of any unauthorized use or suspected breach.
  • We may suspend or restrict the account for violations of these Terms or security risks.
Security

We use reasonable security measures, but no system is perfect. Please use strong passwords and (if available) additional authentication methods.

4. Plans, payments, and renewals

PlatoQR may offer a Free plan and Paid plans. Available features and limits (e.g., number of dishes, languages, custom domain) depend on the active Plan.

  • Prices and commercial terms are shown on the pricing page or during checkout.
  • Paid plans may renew automatically until canceled.
  • Taxes (VAT or equivalents) may apply where required.
  • If payment fails, we may suspend service or downgrade to the Free plan (if available).

Trials and promotions

Any trial periods or promotions (if offered) are subject to the conditions displayed at activation.

Refunds

Unless required by mandatory law or expressly stated otherwise, payments are non-refundable for billing periods already started.

Price changes

We may change prices or plans in the future. Where applicable, changes will be communicated with reasonable notice and will take effect from the next renewal period.

5. Acceptable use and prohibited activities

The Customer agrees to use PlatoQR lawfully and in compliance with these Terms. It is prohibited to:

  • Publish illegal, misleading, defamatory content, content infringing third-party rights, or content violating applicable food/consumer laws.
  • Upload malware, attempt unauthorized access, or interfere with the security/operation of the Services.
  • Circumvent plan limits, reverse engineer the software, or use APIs (if any) without authorization.
  • Use the Services for spam or unfair commercial practices.
  • Upload third-party personal data without a lawful basis or required notices/consents.
  • Use PlatoQR for high-risk activities (e.g., medical or safety-critical decisions) where errors could cause serious harm.

We reserve the right to remove content or suspend services to prevent risks, harm, or violations.

6. Customer Content, responsibility, and license

The Customer retains ownership of its content. However, to provide the Services, the Customer grants PlatoQR a limited, non-exclusive, worldwide license to host, reproduce, process, and display such content solely for technical purposes of providing and improving the service.

  • The Customer warrants it has the rights and permissions to upload and publish the content.
  • The Customer is responsible for the accuracy of menus, prices, allergens, nutritional and food safety information.
  • The Customer is responsible for compliance with local regulations (e.g., allergen disclosure requirements).
  • We may remove or restrict content that violates these Terms or the law.

Translations and automation

Some features (e.g., translations) may be automated. Output may contain errors: the Customer must review and approve information before publishing.

Allergens and sensitive information

PlatoQR is a publishing tool and does not replace the restaurant’s responsibilities. Always verify ingredients, cross-contamination, and warnings.

7. QR code, domain, and publishing

PlatoQR may generate QR codes and public pages. The Customer is responsible for distributing and using QR codes in its premises and materials.

  • Public pages may be accessible by anyone who has the link or QR code.
  • The Customer must ensure public content is appropriate and compliant.
  • Custom domains, where available, require DNS setup and may depend on third-party providers.
  • We may apply technical limits to protect availability and security (rate limits, caching, etc.).

We do not guarantee SEO results or ranking on search engines or Google Business Profile, although we may provide tools and best practices.

8. Third-party services and integrations

The Services may integrate with or link to third-party services (e.g., maps, reviews, WhatsApp, email, payment gateways).

  • Third-party services are subject to their own terms and policies.
  • We are not responsible for outages or changes in third-party services.
  • The Customer is responsible for configuration and compliance with third-party requirements (e.g., accounts, API keys).

9. Availability, maintenance, and support

We aim to keep the Services available and secure. However, outages may occur due to maintenance, updates, or external causes.

  • We may perform scheduled or emergency maintenance without notice when necessary.
  • We may modify, update, or discontinue features, providing reasonable notice when possible.
  • Support (if offered) depends on the Plan and the specified channels.
Backups

We may perform backups for business continuity, but the Customer is encouraged to keep copies of critical content and materials.

10. Personal data and privacy

Processing of personal data is governed by the Privacy Policy.

If the Customer collects data via PlatoQR (e.g., contact requests or bookings), the Customer is responsible for providing notices, lawful bases, and complying with legal requirements.

11. Intellectual property

PlatoQR and its components (software, interface, trademarks, design) are protected by intellectual property rights.

  • You may not copy, modify, or distribute the Platform except as expressly permitted.
  • PlatoQR trademarks and logos may not be used without authorization.
  • Feedback and suggestions may be used to improve the service without obligation to compensate.

12. Disclaimers

The Services are provided “as is” and “as available”, to the extent permitted by law.

  • We do not warrant that the service will be error-free or always available.
  • We do not guarantee specific commercial results (sales, traffic, reviews).
  • The Customer is responsible for reviewing content, especially allergens and prices.

13. Limitation of liability

To the extent permitted by law, PlatoQR will not be liable for indirect, incidental, consequential damages, loss of profits, loss of data, or loss of goodwill.

  • We are not responsible for errors in content provided by the Customer.
  • We are not responsible for outages caused by third parties (hosting, DNS, email, providers).
  • We are not responsible for damages resulting from misuse or non-compliant use of the Services.
Cap

Where limitation is permitted, PlatoQR’s aggregate liability for any claim will be limited to the amount actually paid by the Customer for the Services in the 12 months preceding the event giving rise to the claim, or the minimum required by law if higher.

14. Indemnity

The Customer agrees to indemnify and hold harmless PlatoQR from claims, damages, liabilities, and expenses arising from:

  • Customer Content (including disputes about allergens, prices, and copyright).
  • Violation of these Terms or the law by the Customer or its operators.
  • Improper or unauthorized use of the Services.

15. Suspension, termination, and deletion

The Customer may stop using the Services at any time. We may suspend or terminate access in case of violations or risks.

  • Upon suspension/termination, some public pages may be disabled or downgraded (depending on the Plan).
  • Deleting the account may result in content removal after a reasonable period.
  • Certain clauses (IP, limitations, indemnity) survive termination.

Where required by applicable law, you may have additional rights (e.g., statutory withdrawal periods).

16. Governing law and miscellaneous

These Terms are governed by the law specified in commercial documentation or, if none, by the law of the country where the service provider is established, subject to mandatory rules.

  • If any clause is invalid, the remaining clauses remain effective.
  • Failure to enforce a right is not a waiver.
  • We may update these Terms: the effective version is the one published on this page with the update date.
